Terms and Conditions

These Terms and Conditions (the "Terms and Conditions") are the terms and conditions upon which Fleurishes! (by JuJu)  ("we/us") makes this website (the "Fleurishes! (by JuJu) Floral Design Studio" website), www.fleurishes-by-juju.com,  available to you and upon which we provide our services for delivery of flowers and other associated products under Fleurishes! (by JuJu). This applies to all services accessed via Fleurishes! by JuJu's website, by telephone, by on sight or in store purchase.  This legal notice applies to the entire contents of this website and to any correspondence between us and you. Please read these terms carefully before using this website. Using this website indicates that you accept these terms regardless whether or not you choose to purchase from us.  By using this website, you consent to the use of cookies in accordance with the terms and conditions of Fleurishes! ()by JuJu)'s privacy/cookies policy.

License to Use Website

Fleurishes! (by JuJu) and/or its licensors own the intellectual property rights and all material and content on the website, www.fleurishes-by-juju.com.  All intellectual property rights are reserved.  You may download for caching purposes, view, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.  

You must not:  redistribute material from this website, including any republication on another website; rent, sell, or sub-lease material from the website; reproduce, replicate, copy or otherwise abuse material on this website for a commercial purpose; or alter, edit or otherwise modify any material on the website.

Copyright of this website (including graphics, logos, texts, icons and software) is owned or licensed by Fleurishes by JuJu and Justine De Bouvier. Other than for the purposes of, and subject to the conditions under the Copyright Act R.S.C. 1985, and except as expressly authorized by these Terms and Conditions, you may not in any form or by any means:  adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of this website; or commercialize any information (including but not limited to images, text, videos or sound recordings), products or services obtained from any part of this website, without our prior written consent.  You may not use the trademarks appearing on the website, without the written consent of the trademark owner, Justine De Bouvier.

Prohibited Use

The client is provided with access to this website only for personal and non-commercial use.  You are not permitted to interrupt or attempt to interrupt the operation, functionality or interface of this website, that could in any way adversely affect the availability of its resources to you or to others.
This website may not be used for any illegal purposes, or in a manner that is inconsistent with the Terms and Conditions.

Product Warnings

The flowers and foliage we use in our floral arrangements are not for human or animal consumption, as such, the customer must ensure all reasonable precautions are in place for children and animals.  It is the client’s responsibility to advise us of any floral allergens.  We are not responsible for:  any damage or interference that may arise on the clients computer in connection with the use of this website; use of this website which is illegal or prohibited by laws which apply to only the client; any losses sustained due to unauthorized access to or alteration of transmissions of data or information contained on the clients computer or on this website; or any malfunctions to the clients computer, hardware or software, or any other errors, failures or delays in computer transmissions, lost network connections, or for lost, late, incomplete, misdirected or distorted information.

Unenforceable Provisions

If any provision of the Terms and Conditions set out by Fleurishes! (by JuJu) is, or is found to be, unenforceable under applicable law, it shall not affect the enforceability of the other provisions stated within these Terms and Conditions.


You hereby indemnify Fleurishes! (by JuJu) and our directors, officers, agents and employees (together the “Indemnified Party”) against any losses, damages, costs, liabilities and expenses incurred or suffered by the Indemnified Party arising out of any breach by you of any provision of these terms and conditions.


Barring liability for personal injury (including sickness and death), we will not accept liability to you in respect of any loss or damages (including indirect, or consequential loss or damages) which may be suffered or incurred by you or which may arise directly or indirectly in respect of:  use of this website; losses arising out of use of, reliance on or failure to act on any information contained or accessed through this website; inaccuracy, mistakes or omissions on this website; and/or goods or services supplied pursuant to an order placed through this website.  This disclaimer does not attempt, or bear to exclude liability arising under statute if, and to the extent that such liability cannot be lawfully excluded.

Terms of Service

Any order placed will only be processed if full payment details are given and accepted.   Once an order is received by Fleurishes! (by JuJu), the order gets processed and a confirmation of the order is sent to the customer; once this confirmation has been emailed to the customer, there is a 60% charge to the customer for cancelling their order -  this is due to preparing goods, to be sold, that are perishable in nature.  Due to the nature of the product, orders cannot be cancelled 48 hours prior to the delivery date.  Please contact us at least 48 hours prior to the date of scheduled delivery if the order needs to be cancelled.  There are no refunds or exchanges on orders.  All  sales are final.

PLEASE NOTE:  Please ensure that someone is available to receive the delivery of flowers.  Only two attempts at delivery will be made.  If no one is there to receive the delivery on the second attempt, Fleurishes! (by JuJu) must be contacted by the customer to arrange for a third delivery attempt - it is the customer's responsibility to ensure that someone is available to receive the delivery, or arrange to have the flowers delivered to an alternate location where someone is available to receive the delivery.  Fleurishes by JuJu cannot be held responsible, and is not liable, if no one is available to receive the delivery of flowers.  

We reserve the right to refuse or cancel any orders.

Fleurishes! (by JuJu) cannot be held liable for deliveries delayed or lost due to incorrect delivery information and/or incorrect contact information provided by the customer or if no one is available to receive the delivery of flowers.  It is the customer's responsibility to ensure the correct address and telephone number are provided at the time of order.  As it is the customer's responsibility to ensure someone is there to receive the delivery of flowers.  

Floral arrangements delayed or delivered to the wrong address on account of incorrect information being provided by the customer will not be refreshed or remade.  Refunds will not be given for floral arrangements that have been delivered to the wrong address or delayed on account of incorrect information provided to us.  It is up to the customer to ensure the receiving party is available to receive the flowers and is not away out of town and has not moved.  

Deliveries made to the mail room of a business, a concierge, or to security, are the responsibility of  the mail room associate, the concierge, the security staff to deliver the floral arrangement in a timely manner and in the condition it was delivered in.  Mail rooms, concierge and security do not accept deliveries that are not in good condition.  Our delivery staff will not deliver floral arrangements that are not in flawless condition.  NOTE:  Once the floral arrangement has been delivered to the mail room, the concierge or to security, who has accepted the package on behalf of the recipient, the floral goods become the sole responsibility of the mail room, concierge, security, to ensure the floral arrangement is properly looked after and delivered to the recipient in a timely manner.  

Force Majeure

While Fleurishes! (by JuJu) makes every effort to deliver the order as requested, we will not be held liable for any inability to deliver if done so for any reasons beyond our control.  If, for any reason, the delivery of the floral arrangement(s) cannot be delivered due to reasons beyond our control -  such reasons include but are not limited to fire, flood, adverse weather conditions, explosion, accident or mechanical breakdown, obstruction of any public or private highway, riot, terrorism, government act, act of war, act of God - we will contact both the customer and the recipient of the floral goods by email and by telephone to apprise them of the situation and arrange for an alternate delivery location and/or date.

Revision of Terms and Conditions

We reserve the right to make changes to the goods or content of this website without prior notice.  All such changes, unless specified otherwise, take effect immediately.

**Special promotional offers are only valid online on fleurishes-by-juju.com.  Special promo code must be entered at time of checkout and cannot be combined with any other promo codes/offers/discounts. Offer valid only on in-stock items or specially marked items. Offer not valid on previous purchases. No rainchecks. Not valid for cash or credit. Not valid for in person sales transactions. Offer subject to change at any time and without prior notice. All special promo offers end on time and date as specified in each special promotion and are not valid to be carried over to another date and time. 

Return Policy

At Fleurishes! (by JuJu), we value our customers and strive to provide our customers with the highest of satisfaction by providing the freshest flowers possible.  We stand buy our products.  However, flowers and plants are perishable products; it is the recipients' responsibility to follow the instructions for proper care of their flowers that is provided alongside the flower arrangement(s) or plants.

Flowers in distress show signs of this very quickly, usually within the first eight hours after delivery.  Should this happen, Fleurishes! (by JuJu) needs to be contacted immediately either by the customer or the recipient.  We ask that the flowers originally delivered be retained for the delivery person to pick them up when being replaced by a fresh arrangement -  this helps us in addressing this matter with our suppliers.  

Because flowers can be affected by a host of issues, anywhere along the chain, from the shipper to the supplier, we can only guarantee our handling and care of the botanicals.  Factors, such as, excessive light or excessive heat, humidity levels and water supply, all affect these perishable products; Fleurishes! (by JuJu) can only guarantee that we treat our botanicals with the utmost respect and care.  We cannot guarantee the recipient(s) are providing their flowers with the same care that we do - it is not possible to control the environment we deliver to.  Fleurishes! (by JuJu) will do their utmost to help the recipient of the flower arrangement(s) isolate the issue and provide a solution in remedying this issue.  As such, Fleurishes! (by JuJu) shall replace the bouquet, on a one-time only basis, and only if contacted within 24 hours of the day of delivery -  the signs of distress will be very obvious by the following morning.  Please note, in order for a replacement to be given, the original bouquet must is retained and given to the delivery person, so that we may take this up with our suppliers.

If not completely satisfied with our product, and contacted by the recipient or the customer in an expedient fashion we will gladly replace the flower arrangement in a timely fashion, at no additional cost to our customers.  If there are any concerns about the arrangement(s) delivered, please contact us either by telephone, at 905.941.3288 or 647.883.9891, alternately, we may be reached at 905.935.3059; we may be contacted via the contact page on our website or via email, at JuJu@fleurishes-by-juju.com

Substitution Policy

PLEASE NOTE:  Not all flowers and plants are available at all times of the year.  Many flowers and plants are seasonal.  As such, we reserve the right to substitute flowers or plants, with similar products of an equal or greater value, whilst maintaining the same  colour scheme, appearance and theme.  If we are unable to provide the exact flowers ordered from our products page, we will attempt to notify the customer, but cannot guarantee that a notification to the customer shall be made.  In the event of experiencing supply difficulties, we reserve the right to substitute the products or the packaging, to that of a similar product or packaging of equal or greater than equal value, without prior notice to the customer.    

Flower Care

If properly cared for, flower arrangements should last approximately 7 days, depending upon the flower.  Place the floral arrangement in a properly disinfected vase, keep out of direct sunlight and away from heat sources, as well as, away from drafts; in mixing the flower food, follow the directions on the sachet of plant food provided, alongside the bouquet, for the flowers and change the water in the vase every two to three days.  Never fill the vase up with water, instead, fill the vase with enough water for the stems to comfortably sit in the water -  an inch or two of water is sufficient.  Some flowers, such as calla lilies, are very thirsty drinkers and require having their water changed/topped up daily.  For latex releasing flowers, such as snapdragons, the vase water must be replaced on a daily basis.   

SPECIAL NOTE:  Some flowers, such as, irises, tulips, daffodils and hyacinths, have a much shorter life, lasting approximately 3 to 5 days.  Others, such as carnations, have a very long life, lasting several weeks, most other flowers fall somewhere within the 7 to 10 day range.

Enclosed Messages

IMPORTANT NOTE:  Any personalized messages provided by our customers, to be enclosed in cards sent alongside the flower arrangements on behalf of our customers, shall not contain anything that may be construed as harassment -  whether direct or indirect -,  threatening, intimidating, abusive, rude or vulgar, obscene, derogatory, defamatory, racist or prejudiced, inflammatory, or which may cause embarrassment or distress -  whether intended or not -  to any person, or are otherwise unlawful or objectionable.  We, at Fleurishes by JuJu, reserve the right to refuse to send or display the messages that are deemed objectionable or unlawful, and reserve the right to terminate the order if we deem necessary.  

Privacy Policy

At Fleurishes! (by JuJu) we want our customers to know we take their privacy very seriously.  As such, we guarantee that we will not sell, trade or share, with third parties, any information our customers provide us.  The information our customers provide us are for our exclusive use to contact our customers with respect to their orders or with respect to any promotions, should they have previously indicated interest in  such.

The only information Fleurishes! (by JuJu) collects is as follows:

Email addresses of those that sign up for our e-mailer Newsletters, entitled Just Fleurishes!

Email addresses of those that have signed up for special promotions

Email addresses of our customers

The name, address and telephone numbers of both the customer sending the flower arrangement(s), as well as, the name, address and phone number of the recipient(s) of the flower arrangement(s).  

In addition, Fleurishes! (by JuJu) does collect credit card information used to process orders approved by customers who do not wish to order online, for security reasons.

Also, Fleurishes! (by JuJu) does collect credit card information from customers that are to be used to process orders approved by customers wishing to order online, but unable to do so if the online store is down.

Should a customer order directly from our online store, in these instances, Fleurishes! (by JuJu) does not collect any financial information used to purchase products from our website.  All payment information the customer provides directly to Stripe, a vetted online payment processor that conducts and processes the transaction, using the most sophisticated online security available.  At no point in this process does Fleurishes! (by JuJu) ever obtain access to our customers financial information if they have placed their order online.

IMPORTANT NOTE:  Fleurishes! (by JuJu) maintains both hard copy and soft copy information our customers provide us.  Both sets of records are maintained using the highest standards of security.  Our computer security consist of firewalls, encryption and secure authentication methods to ensure our customers safety -  this is the reason behind selecting Stripe and PayPal as our vetted online payment processors.  The Fleurishes! (by JuJu) website is equipped with SSL or Secure Sockets Layer of encryption as protection -  to verify this, just look for the https//: or the closed padlock symbol  in the web browser -  that allows those visiting our website to browse securely.  In addition, all checkout pages are Level 1 PCI Compliant and use 128 bit SSL encryption;  to confirm secure checkout, simply check the web browser to see the locked padlock item, in addition to, looking for the https//:secure.squarespace.com... in the web browser.  Our hard copy files are safely protected to protect our customers information.  All paper files are kept locked unless in use, and are again locked securely once no longer in use.  

We ensure all reasonable measure shall be taken to protect our customers information, irrespective of the means of transmission.  However, despite using commercial grade measures to protect the privacy of all our customers, 100% security cannot be guaranteed over the internet.  As such,we cannot guarantee or warrant the security of the information our customers disclose or transmit to us online, and cannot be held accountable for the theft, destruction or inadvertent disclosure or our customers personal information. 

If any of  our clients are not comfortable sharing their personal data on the Internet, we are more than happy to accommodate our customers by providing them with the option of calling in their order, at 905.941.3288, or 647-883-9891, or by calling 905-935-3059, so that we may take your order and address your needs over the telephone.

By using our site, the customer acknowledges and consents to our policies.


If a provision of the Terms and Conditions set out in this agreement is determined by any court or other competent authority to be unlawful and/or unenforceable, all other provisions will continue in effect.

The Agreement

The provisions outlined within the Terms and Conditions constitute the entire agreement between the client and Fleurishes! (by JuJu) in relation to your order and use of this website, and supersede all previous agreements in respect of your use of this website.

All prices on the website are quoted in Canadian Dollars, and are listed before taxes.  These Terms and Conditions are governed by the laws in force in the Province of Ontario, Canada.  You agree to submit to the exclusive jurisdiction of the courts of Ontario.  If any of the Terms and Conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.

Donation Policy

At Fleurishes! (by JuJu), we have an ongoing commitment to several charities that we support, however, we recognize an importance to other charitable organizations that might be interested in a donation.  As such, Fleurishes! (by JuJu) is willing to review such a request, provided it agrees to and meets the following criteria:

Fleurishes! (by JuJu) is willing to assist qualified charities in providing floral arrangements at an at cost basis, meaning, we do not donate materials -  either supplies, flowers or vases/containers -, but won't mark up the cost to the charity either.  With the number of requests we receive for donations, we are just not in a position to accommodate as many as we would like and, as such, have opted to accommodate by implementing the following policy:  

        ~ we require an 8 week lead time to review all requests 

        ~ the charity must be a registered non-profit charity, that submits its request in pdf format, by email, on company letterhead

        ~ the details of the letter should include:  the reason for the donation; the date of the event; the number of pieces requested and the location of the pieces; the allotted budget for the pieces, including the flowers, and the vases; if the organization has its own vases, the size and style of the vases to be used, and whether the vases are to be returned to the organization; and the details pertaining to the delivery or pick-up of the flower arrangements by someone from the charitable organization.

We are flattered to be considered for floral arrangements for charitable events and thank all that are considering Fleurishes! (by JuJu) for their event -  we are truly proud to be active members of a community by providing our services.   We are happy to accommodate as many requests as we can, but also recognize there are limitations to what we can do.  To those that have submitted a request for their charitable event, we will inform you if your request has been approved or if we have further questions pertaining to your request.  Thank you for your understanding and for your consideration.
